Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you (the parent, guardian, teacher, or school administrator creating the account) and Upcome for your use of the Upcome learning platform at upcome.app (“Service”). By creating an account or letting a child use the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The service

Upcome provides adaptive practice in math, reading, and science for children ages 5–14, with AI-powered hints from Nova, gamification (XP, badges, streaks), parent dashboards with weekly reports, and free printable worksheets. Free play is available without payment; full curriculum, dashboards, and AI hints require a paid subscription or school plan.

3. Eligibility and accounts

  • Accounts may only be created by an adult (18+) — a parent, guardian, teacher, or authorized school administrator.
  • Children use the Service only through child profiles under a supervising adult’s account, with verifiable parental consent as described in our Privacy Policy.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • One subscription covers the included child seats; extra children are billed at the stated half-price rate. Sharing one child profile between unrelated families is not permitted.

4. Subscriptions, trials, and billing

  • Plans: Monthly ($9/month), Annual ($79/year, ~26% off monthly), and Custom school plans. Prices are in USD unless stated otherwise at checkout.
  • Every paid plan starts with a 14-day free trial. Your card is required upfront, but you pay nothing until the trial ends — cancel during the trial and you are never charged. You are charged only if you continue after the trial.
  • Billing is handled by our merchant of record, Lemon Squeezy. Subscriptions renew automatically until cancelled; cancel anytime from your account — access continues until the end of the paid period and you are not charged again.
  • Refunds are governed by our Refund Policy. Annual plans cancelled after the refund window stay active until the end of the paid year.
  • School and classroom plans are governed by their order form or agreement, which prevails over these Terms in case of conflict.

5. Acceptable use

You agree not to:

  • Share login credentials outside your household or classroom, or resell or redistribute access.
  • Upload unlawful, harmful, or offensive content, or use the Service to bully, harass, or exploit any child.
  • Attempt to extract other families’ data, probe or disrupt the Service, or circumvent access controls or usage limits.
  • Use automated scraping, bots, or load testing against the Service without written permission.
  • Misrepresent AI-generated hints as curriculum certification or professional assessment of your child.

We may suspend or terminate accounts that violate these Terms or endanger children, with notice to the account holder except where immediate action is needed for safety.

6. Educational content and AI disclaimer

Upcome is a practice and enrichment aid — it supplements but does not replace school instruction, professional tutoring, or educational or medical diagnosis. AI hints can be wrong: encourage your child to check reasoning, and consult teachers for learning difficulties. We continuously improve content but make no guarantee that any specific grade outcome will result.

7. Intellectual property

Lessons, questions, artwork, Nova, worksheets, and software are owned by Upcome or its licensors and licensed to you — not sold — for personal, non-commercial learning use while your account is in good standing. Free printables may be printed and shared for classroom and home use with attribution, but not sold or repackaged. You retain ownership of content you provide (such as support messages); you grant us a limited license to use it to operate and support the Service.

8. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, Upcome’s total liability for any claim arising from the Service is limited to the amount you paid in the 12 months before the claim (or $50 if you paid nothing), and we are not liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited by law, or any remedy COPPA or consumer-protection law grants you.

9. Termination

You may cancel and delete your account at any time from settings or by emailing [email protected]; deletion follows the timeline in our Privacy Policy. We may suspend or terminate for material breach, non-payment, or safety reasons, with pro-rata treatment per the Refund Policy. Sections 6–8 and 10 survive termination.

10. Changes, disputes, and contact

We may update these Terms as the Service evolves; material changes take effect 14 days after email and in-app notice, and continued use constitutes acceptance. Please contact us first at [email protected] with any dispute — most issues are resolved within 30 days. School contracts may specify their own governing law and dispute process, which then applies to that relationship.
